Landlords Covenants

  1. Maintenance and Repairs: The Landlord shall maintain the structural integrity of the building, including the roof, exterior walls and foundations, and shall be responsible for all necessary repairs to ensure that the premises are in good condition and suitable for the Tenants use. The Landlord shall also maintain the common areas, including parking lots, landscaping, and any shared facilities. The Landlord agrees to respond promptly to repair requests made by the Tenants and to carry out any necessary maintenance work in a timely manner.
  2. Provision of Essential Services: The Landlord agrees to provide essential basic services to the commercial property, such as utilities (electricity and water), waste disposal, and common area maintenance (CAM), during normal business hours and to address any service interruptions promptly to minimize disruption to the Tenants operation to the best of the Landlords ability.
  3. Compliance with Regulations: The Landlord covenants to comply with all applicable laws, building codes, and regulations related to the commercial property, including zoning ordinances, accessibility requirements, and safety standards, to provide a safe and legally compliant environment for the Tenant’s business operations.

    *Landlords Covenants will be noted in the lease agreement.

Tenants Covenants

  1. Payment of Rent: The Tenant agrees to pay rent in a timely manner according to the terms outlined in the lease agreement.
  2. Use of Premises: The Tenant agrees to use the commercial space only for the purposes specified in the lease and to not engage in any illegal activities or activities that may disturb other Tenants or violate local laws.
  3. Maintenance and Repairs: The Tenant agrees to maintain the leased premises in good condition, including routine maintenance and minor repairs, and to promptly report any significant issues to the landlord.
  4. Compliance with Laws and Regulations: The Tenant agrees to comply with all applicable laws, regulations, and building codes related to the use and occupancy of the leased premises.
  5. Insurance: The Tenant agrees to obtain and maintain appropriate insurance coverage for their business operations and any liability associated with the leased premises.
  6. Subleasing and Assignments: The Tenant agrees not to sublease, assign or lease the premises to anyone else.
  7. Alterations and Improvements: It’s always best to communicate and discuss with the Landlord alterations or improvements prior to making any alterations or improvements to the leased premises as a courtesy.
  8. Indemnification: The Tenant agrees to indemnify and hold the Landlord harmless from any liabilities, damages, or expenses arising from the Tenant’s use or occupancy of the leased premises.
  9. Access and Entry: The Tenant agrees to allow the Landlord reasonable access to the leased premises for inspections, repairs, and other necessary purposes. A courtesy call or text will always apply prior to entry from the Landlord.
  10. Termination and Surrender: The Tenant agrees to comply with the lease termination and surrender provisions, including returning the premises in good condition at the end of the lease term and removing all Tenant improvements or alterations back to its original condition.
